Introduction
Welcome to the It’s Okay App website (https://itsokayapp.com) and related services (the “Website”) and/or mobile application (the “App”). These Terms & Conditions (“Terms”) govern your access to and use of the Website and the App, provided by It’s Okay (“we,” “us,” “our”). By accessing or using the Website or App, you agree to these Terms. If you do not agree, you may not use the Website or App.

Eligibility; Accounts
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority in your jurisdiction, you must obtain parental/guardian consent. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use of your account.

Use of the Website & App
We grant you a limited, non-exclusive, non-transferable license to use the Website and App for your personal, non-commercial use, in compliance with these Terms and all applicable laws. You agree not to:

User-Generated Content; Community Features
If the App or Website allows you to submit, post or share content (e.g., journal entries, peer chat posts, messages, images) (“User Content”), you retain ownership of your User Content but grant us a worldwide, royalty-free, transferable, sublicensable right to use, reproduce, modify, publish, distribute, display and otherwise exploit such User Content in connection with providing and improving the Service. You represent and warrant that you own or control all rights to your User Content and that your User Content does not violate these Terms.

We reserve the right (but are not obligated) to monitor the User Content and to remove any content that, in our sole discretion, violates these Terms or is otherwise objectionable. We may also suspend or terminate your account for violations.

Subscriptions / Premium Services Terms

  • You agree to pay all applicable fees in the amounts and at the frequencies described at the time you sign up.
  • Unless otherwise stated, paid subscriptions begin when you confirm your subscription and automatically renew until cancelled.
  • You may cancel your subscription at any time, but we do not guarantee refunds for any unused portion unless stated otherwise.
  • We may change the pricing, payment methods, and other terms upon notice, and such changes may apply to future renewals only.
  • We reserve the right to suspend or terminate paid features if you fail to pay or if your payment method is invalid.

Intellectual Property Rights
All right, title and interest in and to the Website, App, and all associated content, technology, graphics, logos, trademarks, and software (“Our IP”) are owned by us or our licensors. You agree not to copy, modify, distribute, sell, lease, or otherwise exploit our IP except as expressly permitted by us.

Disclaimers; No Medical Advice
The Service is provided for informational, educational and supportive purposes only and is not intended as, and shall not be construed as, medical or mental health advice, therapy, diagnosis, or treatment. You should always consult a qualified health care professional for advice regarding any mental or emotional health concerns. Your use of the Service is at your own risk.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE (NOR OUR AFFILIATES, LICENSORS OR SERVICE PROVIDERS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE PAST TWELVE (12) MONTHS FOR USE OF THE SERVICE (IF ANY), OR ONE HUNDRED DOLLARS ($100) IF NO FEES WERE PAID.

Termination
We may suspend or terminate your account or access, or remove any User Content at any time for any reason, including breach of these Terms, or if we discontinue the Service. Upon termination, your right to use the Service will cease, and we may delete your User Content. Sections that by their nature survive termination (e.g., Intellectual Property Rights, Limitation of Liability) shall remain in effect.

Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of State of California, U.S.A., without regard to conflict-of-law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Orange County, California.

Changes to Terms
We may revise these Terms from time to time. When we do, we will post the updated Terms and update the “Last Updated” date. Your continued use of the Service after changes are effective constitutes your acceptance of the modified Terms.
